End User License Agreement

Recipe Resizer is designed to be simple, transparent, and yours to use — without the usual complexity or hidden legal traps. By using the app, you’re agreeing to play fair, use it for its intended purpose, and respect the minimal terms outlined here. These Terms of Use explain your rights and responsibilities in a straightforward way — just like the app itself.

Please read through the full terms below before using the app.

1. Introduction

1.1. These Terms of Use (“Terms”), also referred to as the Custom End User License Agreement (“Custom EULA”), govern your access to and use of the Recipe Resizer mobile application (“App”) and related services.

1.2. The App is provided by Night Owl Labs, LLC (“we”, “us”, or “our”). By using the App, you agree to these Terms. If you do not agree, do not use the App.

2. License

2.1. We grant you a non-transferable, non-exclusive, revocable license to use the App solely for personal, non-commercial purposes.

3. User Conduct

3.1. You agree not to use the App to:

• 3.1.1. Violate any laws or regulations;
• 3.1.2. Upload unlawful, harmful, or offensive content;
• 3.1.3. Interfere with the security or integrity of the App;

4. Intellectual Property

4.1. All content and materials within the App — including the code, design, branding, learning content, and original written copy — are owned by or licensed to Night Owl Labs, LLC. This excludes any recipes you create using the App, which remain your intellectual property, and any recipes you import, which remain the property of the respective third-party owners.

4.2. You may not copy, modify, distribute, sell, or lease any part of the App or its core content (such as its code, designs, or branding) without our written permission. However, you are free to share recipes—whether created or imported—using the App’s intended features, including export formats like PDF, HTML, and others supported within the App, provided you respect the terms and privacy policies of any third-party websites from which content is imported.

4.3. If you believe that any content in the App infringes your intellectual property rights, please email support@reciperesizer.com with the following:

• 4.3.1. A description of the work you believe is being infringed;
• 4.3.2. Your contact information;
• 4.3.3. The exact location of the allegedly infringing content;
• 4.3.4. A statement affirming your good faith belief that use is unauthorized;
• 4.3.5. A statement, under penalty of perjury and in accordance with the DMCA (Digital Millennium Copyright Act), that your notice is accurate.

5. Warranty

5.1. We provide the App “as is” without any warranties of any kind, either express or implied.

5.2. We do not provide any warranties, expressed or implied. However, we do offer support and will make a good faith effort to resolve any issues you encounter. If a problem is widespread or deemed urgent, we may release an update to address it. You can reach us at support@reciperesizer.com.

5.3. If you experience issues with the App that may qualify for a refund under Apple’s policies, you may request a refund directly from Apple. All refund decisions are made solely by Apple in accordance with their App Store terms.

5.4. To the maximum extent permitted by law, Apple has no other warranty obligations beyond refunding the purchase price. Any additional claims, damages, or costs related to warranty issues are your responsibility, not Apple’s.

6. Disclaimer

6.1. You use the App at your own risk. We do not guarantee that the App will function without interruption or be error-free. Although we have rigorously tested our conversion and resizer capabilities and have a high degree of confidence in them, we cannot guarantee they are completely error-free. 6.2. External Links

• 6.2.1. The App may contain links to third-party websites or content, including banners or advertisements (via the built-in web browser).
• 6.2.2. These links are not monitored or verified by us for accuracy, completeness, or reliability.
• 6.2.3. WE DO NOT GUARANTEE, ENDORSE, OR TAKE RESPONSIBILITY for any third-party information or services accessed through the App.
• 6.2.4. WE ARE NOT RESPONSIBLE for monitoring or resolving any transactions between you and third-party providers.

6.3. Professional and Health Content

• 6.3.1. The App does not provide medical or health advice. All information is intended for general educational purposes only.
• 6.3.2. Always consult qualified professionals before acting on any information related to health, wellness, or dietary matters.
• 6.3.3. YOUR USE OR RELIANCE ON SUCH INFORMATION IS ENTIRELY AT YOUR OWN RISK.

6.4. Herbs, Mushrooms, and Spices

• 6.4.1. Any images or content related to herbs, mushrooms, or spices are provided for educational purposes only.
• 6.4.2. We strive for accuracy, but cannot guarantee there are no errors or omissions.
• 6.4.3. Consuming wild mushrooms or plants is risky and should only be done under the guidance of a qualified expert.
• 6.4.4. We are not liable for any harm resulting from the use or consumption of these items based on App content.

7. Limitation of Liability

7.1. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.

7.2. Our total liability shall not exceed the amount paid (if any) for the App in the three months preceding a claim.

8. Termination

8.1. If you violate these Terms, we may request that you stop using the App and delete it from your device. While we cannot revoke your access, we reserve the right to refuse future support, updates, or engagement.

9. Communications

9.1. The App includes a single feature—referred to as “Ask Our Chef,” “Email Our Chef,” or “Contact Our Chef” in different areas—which is only intended for culinary or cooking-related questions. It is provided as a convenience to enhance your recipe experience within the App.

9.2. While we appreciate your interest and engagement, use of this feature does not guarantee a response. We reserve the right to reply at our discretion and to discontinue communication at any time without notice.

9.3. We expect all messages to be respectful, concise, and relevant to the App’s intended use. Excessive, repeated, or inappropriate messages may result in the termination of communication privileges, which may include no further responses from our team.

9.4. If we choose to end communication, we are not obligated to provide a reason. This decision may not indicate any wrongdoing or misconduct on your part.

9.5. Continued attempts to contact us after we have ended communication may be treated as spam and may be blocked automatically by our systems or manually at our discretion.

9.6. By using the “Contact Our Chef” feature, you acknowledge that you have read and understood this section and agree to use the feature in accordance with these terms.

9.7. The same guidelines outlined above for the “Contact Our Chef” feature also apply to all related communication channels, including support requests, feedback submissions, and any other messages sent to our team through the App or associated contact methods.

10. Changes to Terms

10.1. We may update these Terms from time to time. When we do, the “Last updated” date will be revised.

10.2. Continued use of the App after changes constitutes your acceptance of the revised Terms.
